Terms and conditions

By using our services you are agree to our terms and conditions.

(1) We shall not refund the token advance received against your verbal/written work order in case of cancellation of such work order from your end. Balance payment will have to be paid to us immediately for the work done.

(2) We shall provide your server-related supports only. No other issues shall be within our purview of service.

(3) Photography & Content writing Charges are extra.

(4) Source Codes & files are the property of EROS Infotech & We shall not provide or transfer it under any circumstances.

(5) We shall not be liable for any legal or otherwise issues/claims, whatsoever, in the event of our executing your job, as the same is being done on your behalf under your verbal/written work order or communication.

(6) All development will be done on our servers and then migrated to client’s servers after receiving the final dues from the clients. ErosInfotech reserves the right to make any modifications, addition and deletion if considered necessary or desirable without prior notice at any time.

(7) Any extra modules required or any addition or changes in the modules other than specified in the offer shall be made available at extra cost. We will be able to change your design only once after the initial mock up , further changes requires additional charges will be done after the additional payments have been done.

(8) Data Entry work to be done by the client only. All the information are accepted in softcopy only. Our team consist of remote workers to cater to the needs of global client base.

(9) Incase of any reference sites the website design & format will not look 100% exactly similar to the referenced sites, We will try to adopt a similar feel  ( not exact ) to your website. Few Functions / elements/changes will not be possible due to technical & other limitations – the limitations could be because of many factors which are out of our control.

(10) Failure to Provide Required Inputs: To deliver our services to you based on your requirements, all supporting documents/information/sketches whatsoever shall be supplied by you immediately at your cost and risks, and we shall not be liable for the quality of the same. In case the delay in executing your verbal/written service requirement happen to be due to your not supplying the required data/information/documents/sketches whatsoever on time, we shall not be responsible for the same, and payment (either balance or full) cannot be withheld at your end. We shall not accept any excuse in not providing timely details.

(11) In the event of laxity at your end in providing required inputs as mentioned in point no.11, we have the right to impose 50% additional cost as well as to close the project on as is where is basis.

(12) For Graphic work, our responsibility is confined up to design only. We shall not be responsible for the outcome of the graphic work with regard to colour combination/printing.

(13) The Quotation/contract approval is subject to the approval of clauses & terms and conditions herein. We charge 100% contract/Quotation amount in case of breach of any terms & Conditions or clauses.

(14) All taxes/levies, as applicable, are extra.

(15) All 3rd party services used in the website shall be the sole property of those parties and ErosInfotech is not liable incase of any service gaps or interruptions by them.

16) We will not be liable to you for any incidental, special or consequential damages of any kind that may result from use of or inept handling at your end. In such circumstance(s) you cannot take any legal action against us.

(17) Email configuration & email data backup arrangements are not falling within the purview of our services. Spam email Marketing is not allowed.

(18) We don’t refund at any circumstances. No guarantee & warrantee for any services.

(19) Website update and maintenances charges are extra.

(20) Taxes & other levy charges  Extra.

(21) Website domain name is our property ( unless owned by client previously ) and we don’t transfer it to anybody.

(22) In case you do not provide required inputs to be put in the services required by you, we shall use images, content, web programming and effect from internet and therefore copy right issues are of not our responsibility. However, we sincerely suggest our clients to use only authentic inputs to avoid any issues.

(23) Any issues arising out of this proposal or quotation or work order or requirement shall be subject to Bangalore jurisdiction.

(24) Renewal of Domain & Hosting: We do renewal every year on your behalf and will not pass on to third party. Renewal charges at actual shall be paid by you upon our intimation. It is also the responsibility of the client to ensure renewal amounts are a paid to us at-least 1 month before the expiry date.

(25) ErosInfotech Update Request Services :The number of updates (during the website development) and modifications carried out by ErosInfotech team on behalf of the customers is limited by our Fair Usage Policy – Only 1-2 modifications will be done max. The intent of ErosInfotech’s Fair Usage Policy is to provide the optimum service experience to all customers. Under the policy we have defined fair usage levels for the number of modifications and updates allowed. Our Fair usage Policy is such that most customers will not be affected by it. Abuse of the Fair Usage Policy is defined as: More than 2 update requests per website sent to the ErosInfotech team in any given month which can impair the experience of others. Over and above 2 update requests per website in a month will be charged. All updates subsequent to project delivery are chargeable.

(26) Content submission :Although ErosInfotech firmly believes in the value of free and open dissemination and exchanges; however, it is under no obligation, but does reserve the right, to monitor, pre-screen, or otherwise remove any content stored in its servers if the content is against the public policy as the law of the land (India). Therefore, erosinfotech cannot be responsible for the appropriateness, accuracy, sufficiency, correctness, veracity, completeness, or timeliness of such thoughts and opinions. Customer acknowledges that Customer should always use caution when posting any personally identifying information about Customer or Customer’s employees on the Service, the Customer Site, or any other user sites.

(27) Erosinfotech may be or may not be an affiliate to the different 3rd party service providers whose services are being  used in the website. ErosInfotech is not liable under any circumstances for the loss arising out of or In connection with the use or inability to use the service .

(28)Third party Content :For Customer’s convenience, the Service may contain products, services, content and information from third party providers (which includes advertisers and affiliates) and/or links to their Web sites (“Third Party Content”). Such Third Party Content is not under the control of ErosInfotech and ErosInfotech is not responsible for such content, including, without limitation, any link contained in such content, or any changes or updates to such content. ErosInfotech is under no obligation, but does reserve the right to pre-screen Third Part Content available on the Service and does not assume any responsibility or liability for the content provided by others. ErosInfotech is providing such Third Party Content to Customer only as a convenience, and the inclusion of such content/Service does not imply endorsement by ErosInfotech of such content or the affiliate or advertiser. Customer may be subject to additional and/or different terms, conditions, and privacy policies when using third party products, services, content, software, or sites. ErosInfotech does reserve the right to remove content that, in ErosInfotech’s judgment, does not meet its standards, but ErosInfotech is not responsible for any failure or delay in removing such material.

By using our services you are bound by our terms and conditions.

Limitation of Liability :
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT OR OTHERWISE, IN NO EVENT SHALL EROSINFOTECH AND/OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL OR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF USE, DATA OR PROFITS (HOWEVER ARISING, INCLUDING NEGLIGENCE) EVEN IF EROSINFOTECH OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES, ARISING OUT OF OR IN CONNECTION WITH (A) THE USE OR INABILITY TO USE THE SERVICE, (B) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, (C) FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICE OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICE, (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR (E) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT SHALL EROSINFOTECH AGGREGATE LIABILITY TO CUSTOMER AND/OR ANY THIRD PARTY ARISING FROM OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNT CUSTOMER ACTUALLY PAYS TO EROSINFOTECH UNDER THIS AGREEMENT DURING THE TWELVE (12) MONTHS PRECEDING THE DATE
